Virginia divorce laws allow married couples to file both no-fault and fault-based complaints for divorce. No-fault grounds for divorce are based on how long parties have lived separate and apart. Who is at fault is not a consideration.  A no-fault divorce can be obtained after a period of separation, either 12 months or 6 months, depending on your circumstances. 


Virginia also recognizes fault-based divorces.  Fault grounds for divorce include cruelty, desertion (abandonment), adultery, sodomy, and conviction of a felony.  Cruelty can involve conduct such as domestic violence.  Your lawyer will determine the most appropriate type of divorce for your situation during your consultation with us.
