Same-Sex Marriage Means Same Sex-Divorce

Same-sex marriage has been legalized as of October 6, 2014. As a result, this also means that same-sex divorce now exists. Divorce is often emotional and contentious, and the dissolution of a same-sex union is no different. As part of the divorce process, the Court has the authority to make decisions regarding the following:

Property Distribution: The Court can determine which assets and debts are considered marital property or debts, and it can divide the marital property and debts between the parties.
Spousal Support: The Court has the authority to award spousal support (alimony) to either party on a temporary or permanent basis.
Custody and Visitation: The Court has the authority to make decisions regarding the custody and visitation of the minor children born or adopted by the parties.
Child Support: The Court will determine each party’s child support obligation in accordance with the Virginia child support guidelines.
Other Issues: The Court will determine the grounds for divorce, and whether either party should be awarded attorney’s fees and costs associated with the litigation.
